Questions

Why is the term 11 months in most rent agreements?

Under the Registration Act, a lease for a year or more must be registered, so many states see 11-month agreements to avoid that. Some states, Maharashtra among them, require registration of leave and licence agreements of any length.

What should both sides check in the draft?

Names as on ID, the flat number, rent and its due date, deposit, lock-in, notice period, escalation on renewal and who pays maintenance. A wrong name or date means stamping and signing again.

Tips

  • Summarise the money terms in the message; most people read the message, not the PDF.
  • In Maharashtra, section 55 of the Maharashtra Rent Control Act, 1999 requires leave and licence agreements to be registered; check your state’s rules before promising a date.
  • Send the same draft to owner and tenant at the same time, so neither feels the other got a different version.
