RERA registration for real estate agents: rules, fees and validity by state

Under the Real Estate (Regulation and Development) Act, 2016, a real estate agent must register with the state’s RERA authority before helping anyone buy or sell a plot, apartment or building in a RERA-registered project. One registration covers the whole state. The state’s rules set the fee, the documents and how long the registration lasts, so the numbers differ from state to state.

Who counts as a real estate agent under RERA?

Section 2(zm) of the Act defines a real estate agent as anyone who negotiates or acts for one person in the sale of a plot, apartment or building in a real estate project and is paid for it, as commission or otherwise. It also covers anyone who introduces prospective buyers and sellers to each other, through any medium.

So the definition is about the work, not the job title. An individual broker, a brokerage firm, a channel partner selling a builder’s project and an online platform that introduces buyers can all fall within it.

What the Act requires: Sections 9, 10 and 62

Section 9 says no agent shall facilitate the sale or purchase of any plot, apartment or building in a project registered under Section 3 without first registering. You apply to the authority of the state where you work, in the form and with the fee its rules prescribe. The authority grants “a single registration” for the entire state or union territory, or rejects the application in writing after hearing you. If it neither rejects nor points out a deficiency within the period set by the rules, you are treated as registered.

Once registered, you must quote your registration number in every sale you facilitate. The authority can suspend or revoke the registration, after a hearing, if you break its conditions, the Act or the rules, or if you got it by misrepresentation or fraud.

Section 10 lists your duties as a registered agent:

  • Do not facilitate the sale or purchase of any plot, apartment or building in a project that is not registered with the authority.
  • Maintain and preserve books of account, records and documents as the state rules prescribe.
  • Do not use unfair trade practices: no false claims that your services are of a particular standard or grade, no claims of approvals or affiliations that you or the promoter do not have, no false or misleading statements about your services, no advertising of services you do not intend to offer.
  • Help the buyer get the information and documents they are entitled to when they book.
  • Carry out any other functions the state rules prescribe.

The penalty for not registering

Section 62 applies when an agent fails to register under Section 9 or breaks a duty under Section 10. The authority can impose a penalty of ₹10,000 for every day the default continues, which can add up to 5% of the cost of the plot, apartment or building whose sale or purchase you facilitated.

As an illustration, on a ₹1.2 Cr flat 5% is ₹6 L. The ceiling is tied to the cost of the property whose sale was facilitated, so exposure grows with every unregistered deal.

How to apply

The steps are broadly the same everywhere; the forms, documents and fee are set by each state’s rules.

  1. Open the agent registration section on your state RERA authority’s portal and create an account (Rajasthan uses the state’s SSO sign-in, for example).
  2. Fill in the application form — Form REA-I in Haryana, Form G in Uttar Pradesh, Form-H in Rajasthan, Form VII in Goa.
  3. Upload the documents your state asks for (see below).
  4. Pay the registration fee through the method the rules allow — demand draft, NEFT/RTGS or online.
  5. Answer any deficiency notice. Haryana’s rules give the authority 30 days to decide and allow 30 days to fix defects; Goa’s rules also set 30 days.
  6. Download your registration certificate with its registration number and start quoting the number in every sale.

Documents states typically ask for

In Rajasthan, Uttar Pradesh, Haryana and Goa the rules ask for the enterprise’s name, address and type, its registration papers (bye-laws, memorandum and articles of association, or partnership deed), photographs of the agent or of each partner or director, an authenticated copy of the PAN card and proof of the business address. Some states ask for more:

  • Uttar Pradesh: income-tax returns for the three preceding financial years, or a declaration if you are exempt.
  • Goa: Aadhaar and DIN details, photos of staff assigned agent work, the branch offices, the projects and promoters you acted for in the last five years, pending civil or criminal cases, and copies of the letterheads, rubber stamp and receipts you will use.

Fees, validity and renewal in four states

These figures come from each state’s rules as published by its authority on 12 October 2026. “Other than individual” covers firms, LLPs and companies. Rules change, so confirm the current amount on the portal before you pay.

Haryana note: the 2017 rules, as amended in 2019, set ₹25,000 for an individual and put sole proprietorship firms in the “other than individual” slab. A HARERA Gurugram process document quotes ₹50,000 for an individual — confirm the amount with HARERA before you apply.

Uttar Pradesh: training comes before the application

UP RERA’s agent registration manual makes its four-day classroom Real Estate Agent Training and Certification Program mandatory before you apply. It runs in Lucknow and Greater Noida, you must attend in full to sit the exam, and the fee is ₹6,000 for each employee declared in your profile. The registration form opens only after UP RERA uploads your certificate.

What changes in day-to-day work

The Act requires your registration number in every sale you facilitate. Some states go further: Goa’s rules require the number to be displayed at your main office and branches and quoted on all advertising, marketing, selling and purchase documents together with the project’s registration number. Check your state’s rules before you print a hoarding or post a listing.

Keep records too. Rajasthan’s rules ask agents to maintain books and records as required under the Income Tax Act, 1961, and Goa’s ask for separate books for each project. Plan the renewal date months ahead, because Rajasthan, Uttar Pradesh and Haryana want the application three months before expiry.

In PropZolo the project catalogue keeps each project’s RERA number, project pages for registered projects cannot be published without the RERA block, and channel partners add their RERA agent number with its expiry date so you get a reminder before it lapses.

Questions

Is RERA registration mandatory for real estate agents?

Yes, if you facilitate the sale or purchase of a plot, apartment or building in a project registered under Section 3 of the RERA Act. Section 9 bars agents from doing that without registering with the state authority first.

Do I need RERA registration for rentals or resale deals?

Section 9 is written around sales in RERA-registered projects sold by the promoter, so it does not clearly reach rentals or resale of older homes. Some states’ rules or orders may say more, so check your state authority’s portal before you decide you are outside it.

How long is a RERA agent registration valid?

The Act leaves it to the state rules. It is five years in Rajasthan, Goa and Haryana, and ten years for the first registration in Uttar Pradesh (renewals there last five years).

Does one registration cover the whole state?

Yes. Section 9 provides a single registration for the entire state or union territory. If you facilitate sales in two states, you register in each.

What is the penalty for working without RERA registration?

Under Section 62, ₹10,000 for every day the default continues, which can cumulatively extend up to 5% of the cost of the property whose sale you facilitated, as decided by the authority.

Can a company or firm register as a RERA agent?

Yes. The rules have a separate fee for applicants other than individuals, and UP RERA accepts sole proprietorships, partnerships, LLPs, companies and societies. Goa asks for photos of staff assigned agent work, and UP RERA’s training fee is charged per declared employee.
