TRAI’s 7-day enquiry window: what real estate brokers must change

In September 2026 TRAI amended its commercial communication rules (TCCCPR). For brokers, two changes matter most: follow-up messages based on an enquiry now have a seven-day limit, and automated calls must be declared in advance. Here is what that means in day-to-day work — and how to stay on the right side of it without slowing down.

What changed

Commercial messages sent because someone enquired are allowed only for seven days from the enquiry. The enquiry must have been made in writing or digitally — a portal form, a website form, a WhatsApp message — and the sender must keep it in a verifiable form.

Calls made by auto-diallers, robo-calls, pre-recorded messages or AI voice must be declared to the telecom operator in advance, along with the caller IDs used. Undeclared ones count as unsolicited commercial communication.

TRAI also tightened complaint handling and header and template misuse. Check the gazette text for effective dates and details.

What it means for a brokerage

A buyer who enquired on a portal on Monday can receive your promotional SMS and calls until the following Monday. After that, you need their registered consent — or you stick to service and transactional messages about something already in progress.

  • Keep the original enquiry — the portal push, email or form submission — with the lead.
  • Record when the enquiry happened, not just when the lead was created.
  • Stop promotional SMS and calls after seven days unless consent is registered.
  • Declare any software-initiated dialling before using it.
  • Honour opt-outs on every channel immediately.

What about WhatsApp?

WhatsApp messages are not governed by TCCCPR, but Meta’s own opt-in and template rules apply, and so does the DPDP Act. In practice WhatsApp becomes the main follow-up channel after the first week — with consent and approved templates.

How to make it automatic

The safest system is one where agents can’t break the rule by accident. That means the CRM knows when each enquiry happened, keeps the evidence, and checks the window at the moment of sending — not in a monthly audit.

  • Store enquiry time, channel and raw evidence on every lead.
  • Gate promotional SMS and calls on the window or on registered consent.
  • Keep DND, quiet hours and DLT template checks in the same send path.
  • Log every decision so you can show why a message was or wasn’t sent.
